The project “Legal Barriers Affecting Older Workers in the Workplace” is part of a Cooperation Agreement between the HRREC and the Canadian Human Rights Commission (CHRC). The purpose of the project is to contribute to the CHRC’s research on aging in the workplace that could contribute to the development of relevant policy on this matter.
During the Fall 2016 term, the HR Clinic made a critical review of the jurisprudence in relation to the type of legal barriers faced by older workers that reinforce barriers related to entry to and exit from employment, training and skills development, advancement and performance. Legal barriers refer to barriers within jurisprudence (both theoretical and practical) that are of a structural, institutional and interpretive nature. In analyzing the legal barriers, a comparison has been made between those affecting older workers, those affecting people with disability, and those affecting older workers with a disability and/or growing into disability.
